Our Contracts
We provide two specialist contracts designed for using in a car share arrangement, and more information about them can be found below. They are drafted carefully to take into account the issues that are most important when sharing a car, such as security, paying for fuel and liability for accidents, and they have been reviewed thoroughly by a solicitor experienced in contract law. Each agreement comes with detailed drafting and guidance notes explaining the operation of the contract and the reasoning for its contents in order to help you complete the contract to suit the needs of your individual sharing situation. These notes also include examples of additional clauses and schedules that are available to customise your agreement, and provide guidance on drafting your own clauses if necessary.

Why Car Share? Different people are interested in sharing a car for different reasons. The top three are as follows:
- Finances – Car sharing is much cheaper than owning your own car – you can divide the costs associated with owning, storing, maintaining and using the car amongst the sharers, and so everyone pays much less than they would individually. Car sharing may be the only way that you can afford to buy that dream car, be it vintage, sporty, spacious or just the latest model.
- The environment – Members of a car share club do not have the unlimited access to a car that they would have if they owned their own car. This helps to encourage sharers to carefully consider which journeys need to be made in a car, and which can be made on foot, by bike or using public transport. Car share clubs mean that there are fewer cars on the road, which should help congestion and pollution. It also helps to reduce the demand for manufacturing new cars and the scrappage of old ones, thus wasting fewer resources.
- The community – If a car can be shared with others this should help to reduce the number of cars parked on local streets and lanes, making parking easier for other residents. Congestion is likely to be reduced for those people who do have to drive.
These factors may operate together to convince people that car sharing is a good solution. Imagine the following example:
Families A, B and C each own a car and park them on their road, which makes the street very busy and difficult for others to park. The families all feel they do not use their cars often enough to make ownership worthwhile, and they decide between them that they should share one car instead. All of the families will save money as they will no longer be paying separately for road tax, insurance, servicing, parking permits, MOTs and breakdown cover. These costs can be split between families A, B and C, and each family’s contribution will be far less than they were paying. The shared car will not always be available, so the families will have to think more carefully about when they really need to use it, and when they could cycle to school or work, walk to the shops or get the train to visit friends or family. The families are more likely to share lifts together if they have similar lifestyles and there will only be one car between them on the street outside their houses, rather than the original three. Those two unused vehicles will no longer be left sitting around as wasted assets, and could be sold on.
Our Contracts
If you are interested in sharing a car with other people, these are the two agreements that we sell to help you to achieve it:
A1 – Car Share Agreement: Shared Ownership Model
- Use this when the car will be owned by all of the people sharing it.
- Provides for the running costs to be split according to how much each person uses the car.
A2 – Car Share Agreement: Shared Use Model
- Use this when one person owns the car, and rather than selling shares in the car to others, will calculate and charge the others an annual rate and a mileage rate to cover the running costs of the car.
